"In the early hours of this morning, immediately after the start of working hours, the judge was presented with a constitutional ruling, she got acquainted with it and issued the release order," said the spokeswoman for the Sokol court, Gabriela Siegelová. Tempel is thus the third life-sentenced prisoner in the Czech Republic, he got free. He left the prison at 9:30 am.

Based on the decision of the Constitutional Court, the District Court in Sokolov should have immediately ordered the release of Tempel. However, the decision of the court did not arrive in the data box of the Sokol District Court until 3:00 p.m. on Tuesday, when the court's working hours end.

< p>According to Ondřej Kroupa, director of the Bělušice prison, where Tempel was serving his previous sentence, the staff of the facility were ready to release Tempel even at night, but the prison did not receive signals from Sokolov that the court would issue an instruction.

The Tempel Case

Tempel was sentenced to 5.5 years in prison in 1996. He was released on parole. However, he committed robbery while on probation, so the justice system decided that he would serve the rest of the sentence, i.e. 457 days, as well as another 13.5 years just for robbery. He was subsequently given a summary life sentence for a double murder in 2001, which he denied committing.

After interventions by the European Court of Human Rights in Strasbourg and the Czech Constitutional Court, however, Tempel was recently acquitted of murder charges for lack of evidence. But the Prison Service ordered him to serve the remaining 457 days of his original sentence. According to the constitutional judges, Tempel had already served the older sentences, so further detention while serving the sentence was unconstitutional.

The double murder, for which Tempel was punished, happened in the forest parking lot near Hrušková in Sokolovská. According to the overturned judgment, Tempel gave his victim 400,000 crowns for a car that he allegedly wanted to buy. Subsequently, he allegedly shot the man and hit the other man, according to the indictment, and then hit him in the head with an iron bar with a piece of concrete and a wrench. According to the prosecution, he buried both bodies the next day in Chebsk.
