Last year, the authorities refused to issue a 33-year-old Ukrainian university student with a temporary residence permit because they are convinced that her marriage in August 2016 was purposefully concluded.

She wants to prove through the courts that this is not true. Her husband ignores the trial. The case will now be decided by the Supreme Administrative Court.

Four months after the wedding, the newlyweds had an unpleasant test. The Czech authorities asked them for details about their relationship and personal life.

Under what circumstances they met, how many guests were at the wedding, they were also interested in who bought the wedding bouquet. The woman claimed that the bouquet was bought by her husband. He said again that his future one had bought it and he didn't even know where.

They also crashed on their wedding rings. The wife said they were silver and her husband paid them, he said they were made of stainless steel and paid half.

"In case of suspicion of a marriage of convenience, it is always necessary to check the situation, which is mainly done by the statements of both spouses. There is also an opportunity to check the cohabitation of spouses in the household by the Police of the Czech Republic, more precisely by visiting the place of residence of the married couple, "said Hana Malá from the Communication Department of the Ministry of the Interior.

Helena Grundmanová, director of the non-profit organization Most pro, which has been trying to help foreigners in Pardubice for a long time, claims that special-purpose marriages due to residence permits are not exceptional. But finding out is difficult.

"Examination of spouses is very unpleasant and evaluation is sometimes not correct. Where marriage is purposeful, and we know it, they will not find out. On the contrary, sometimes a wedding is sometimes called a special purpose, where the relationship is real, "she said.

According to her, some questions are unexpected. "Or do you know the color of your wife's toothbrush?" When you're not quick and you're not smart enough, you're easily involved. On the contrary, where there is a purposeful marriage, the couple is more likely to prepare for questions, "she said.

Martin P., for example, did not remember the name of one of the two underage daughters who live in Ukraine, and he married them. On the contrary, he knew the exact date of the wedding, but his partner was wrong about a month.

However, according to the information resulting from the judgment of the regional court, the authorities had no doubts about this marriage in August 2016. The wedding took place a week before the newlywed's visa expired.

In addition, the university married a man who lived in a sheltered home at the Bystré chateau. It focuses on helping people with mild to moderate mental disabilities.

The director of the home, Ivo Musil, found out about the client's wedding late.

"It was a surprise to me, but he is independent and private life is purely his business. If he did not need to consult, we cannot intervene in these matters, "he said. He had never encountered anything like it.

"He used our field services, it is the support of independent living, which we now provide to nineteen clients. He no longer uses our social services, he decided to live alone, "said the director.

Police: It's a marriage of convenience

During a residence inspection in Polička a year and a half ago, the police did not find any traces of the woman's presence in the sheltered housing in Polička, even though she stated this address as her place of residence. Instead, she found out that another client of the Home at the chateau was using the apartment.

According to them, the couple did not actually lead a married life. The Ministry of the Interior therefore rejected the application for a temporary residence permit, stating that it was a marriage of convenience and circumvention of the law.

"In the event that the answers of both spouses in basic matters do not agree or completely diverge, the investigation of the Czech Police also does not confirm cohabitation, or further investigation reveals the falsity of the data provided in the statement, the situation may be evaluated as a marriage contract," said Malá.

According to the police, the marriage was organized by another person and Martin P. was "very likely to be used to do so". But no one was prosecuted for it.

"Our investigation did not prove that the person who organized the marriage would gain property or other benefit," said the spokesman of the Svitavy police, Ondřej Zeman.

While Depardieu is expelled from the country in Green Card, Tamara from Ukraine stays in the Czech Republic and continues to work. She did not accept the authorities' verdict and filed a lawsuit, claiming that an "emotional bond" had been formed between the couple and that they were "planning for the future".

The judges of the Pardubice branch of the Regional Court in Hradec Králové did not believe this and dismissed the lawsuit in January this year. According to the verdict, he describes the actions of women "as an attempt to formally prove coexistence that does not really exist."

Spouses from holiday destinations

Tamara P. does not want to talk about her marriage in the Czech Republic. "The matter is pending, a cassation complaint has been filed, the client does not want to comment on it," said her lawyer Vilém Vinopal.

It is not clear how many purposeful marriages officials in the Czech Republic reveal each year. According to Hana Malá, the Ministry of the Interior does not keep such statistics. What is certain is that in many cases the authorities are powerless.

For example, when it comes to marriage, which one of the partners takes seriously, but for the other it is just a ticket to living in a richer part of the world.

"It repeatedly happens that a Czech woman falls in love during a recreation in Egypt or Tunisia. It is real for her, but sometimes it is purposeful on the part of the man, because he just wants to get to the countries of the European Union, "said Grundman.
