Sanctions for traffic accidents: What is the penalty for a crash?<

1) Accident as a misdemeanor – only sheet metal

In the event of a traffic accident that does not result in injury or death, the penalties are relatively mild. On the spot fine up to 2,000 CZK, in administrative proceedings from 1,500 to 2,500 CZK.

But beware, a more severe sanction may be considered due to the cause of the accident. Failure to give the right of way is on the spot up to 2,500 CZK and in administrative proceedings from 2,500 to 5,000 CZK.

There are no points for this, but again only if it is not a failure to give way (4 points) or a danger when crossing from lane to lane (5 points).

2) Accident as a misdemeanor – minor bodily harm

If you cause a traffic accident, injure someone, and the period of incapacity for work does not exceed 7 calendar days, it is still a misdemeanor.

Sanctions, however, are significant - a 25,000 to 50,000 CZK fine, a driving ban for 1 to 2 years.

3) Accident as a criminal offense - minor bodily injury

If you cause a traffic accident, injure someone, and the injured party's incapacity for work exceeds 7 calendar days, it is already a criminal offense of bodily harm due to negligence, i.e. such a matter will no longer be discussed in administrative proceedings, but may end up in court. The basis of the procedure in each such matter, or every accident where there is an injury is not reported without prior consultation with a lawyer. Of course, we're talking about accidents here, not intentional injury.

The sanctions are as follows: if only one person is injured, the penalty is imprisonment for up to one year, a driving ban for up to 10 years and a fine. If more than one person is injured and the violation is "gross", the risk is up to three years in prison, a driving ban of up to 10 years and a fine.

4) Accident as a criminal offense – serious injury to health

In the event of an accident where the injured party is injured for more than 6 weeks or a person is killed, the following penalties apply:

In the basic rate for driving vehicles, there is a risk of imprisonment for six months to four years, a driving ban and a fine.

However, if the driver causes serious harm to the health of at least two people because he grossly violated the rules of the road, he will be punished by imprisonment for two to eight years, a driving ban and a fine. Plus 7 points.

5) Accident as a criminal offense - general endangerment

For general endangerment due to negligence, the rates are basically the same as for serious injury to health, with the difference that if the driver causes by his actions (i.e. exposed multiple persons risk of death or serious injury) death of persons, there is a rate of 3 to 10 years, a driving ban and a fine.

A general threat can be understood as e.g. braking, dangerous overtaking in heavy traffic, etc.
